In certain circumstances people may not wish the laws relating to financial provision to relate to their circumstances.
It may be that it is a matter of agreement between the parties that certain financial assets will be excluded from any sharing process.
This might be particularly true if one or both of the parties have children from previous relationships and wish to make sure that they are provided for.
It is possible to enter into a Pre Nuptial Agreement which sets out, in advance, the terms of any financial settlement in the event of separation.
Cohabiting couples may not wish their finances to be intermingled and can enter into a Cohabitation Agreement which is signed at the beginning of the relationship and sets out the terms of any financial settlement in the event of the relationship ending.
